We provide residential real estate marketing and guidance in Arizona. Any brokerage services are provided under the applicable broker of record and subject to a signed representation agreement. Online content is informational only.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EAST VALLEY HOMEGIRL, NIKKI SMITH, AND OUR AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID US FOR THE SERVICE AT ISSUE IN THE PAST 12 MONTHS, WHICHEVER IS GREATER.

14) Governing law & venue

These Terms are governed by the laws of the State of Arizona without regard to conflict-of-law principles. The exclusive venue for permitted court proceedings is the state or federal courts located in Maricopa County, Arizona, and you consent to personal jurisdiction there.

15) Dispute resolution & arbitration

Most issues can be resolved informally. If we cannot resolve a dispute within 30 days, you and we agree to binding individual arbitration administered by a recognized provider on a confidential basis in Maricopa County, Arizona. Class actions and jury trials are waived. You may opt out of arbitration within 30 days of first agreeing to these Terms by emailing [email protected] with subject “Arbitration Opt-Out”. This section does not prevent either party from seeking temporary injunctive relief in court to protect IP or confidential information.

16) Changes to terms

We may update these Terms at any time by posting a revised version on the Site. The “Effective” date above shows the latest version. Your continued use after changes means you accept the new Terms.
